Users who use the services offered by the DIVINITINERARI.IT website (the APP or the Platform) declare that they know and accept these Terms and Conditions ("Terms").

2. Information

Divinitineari is both a web platform and an Ios and Android application for food and wine tourism, which aims to make experiences at wineries and farms more accessible to customers and to directly connect producers and connoisseurs, with the opportunity for producers to promote and sell their products (also connected to events).

Free content and paid content will be available on the Platform and in the App, which can be purchased directly by users through an e-commerce service.

3. Services Offered

The user will be able to book food and wine tourist experiences in unique locations offered by exclusive partners in the sector (e.g. wineries, SPAs, B&Bs and others, "Partners").

4. Subscription, registration, cancellation

To use the services offered and make online purchases, the User must register.

By registering, the user can consult the summary of his reservations and/or purchases and monitor their status.

During registration and in order to purchase one of the services offered, the user must truthfully and completely provide the following data: name, surname, valid and active e-mail address, no. phone and payment details.

At the time of registration or purchase of services, the user declares to accept these Terms.

During registration, the User must also provide a password of at least 6 characters. By registering, the User can also take advantage of the newsletter service and receive updates on activities, experiences, tours, wineries, products, etc.

The User has the duty to guard and keep his access credentials confidential. If this data should be lost or stolen or if it is suspected that unauthorized access has been made to your account by third parties, the registered User must promptly notify Divinitinerari and change their access credentials as soon as possible. It is understood that under no circumstances can Divinitinerari be held responsible in the event of loss, dissemination, theft or unauthorized use by third parties, for any reason whatsoever, of the User's access credentials.

The registered User may request the deletion of the account by contacting Divinitinerari directly. In the event of violation of these Terms, Divinitinerari reserves the right to suspend or terminate the User's account at any time and without notice.

5. Conclusion of the contract

By clicking on "Book" the User sends Divinitinerari a purchase proposal for the chosen services. Upon receipt of the request, Divinitinerari will automatically send the User an initial message of receipt of the proposal ("Booking Reception").

With this communication, Divinitinerari merely confirms to the User that it has received the order and that it has undergone a data verification process and the availability of the Services at the Partner offering the service.

The purchase is considered completed only with the receipt of another e-mail ("Booking Confirmation") with which Divinitinerari - on behalf of the Partner - confirms to the User acceptance of the proposal and payment.

With the completion of the purchase, the contractual relationship exists directly between the User and the Partner, who remains entirely responsible for the conformity of the service offered and promoted by Divinitinerari.

6. Duration

The duration of the Services is indicated at the time of payment of the fee and confirmed in the order confirmation email sent by Divinitinerari.

7. Withdrawal

By virtue of the right of withdrawal, the User may, within 14 days from the date of the Booking Request and no later than two days from the expected date of provision of the Service, make a refund request, sending notice to Divinitinerari via the contact information provided available in this document and including in the request the identification details necessary to identify the purchase to which the refund request refers.

After carrying out the appropriate checks, Divinitinerari will proceed with the refund within 14 days of receiving the request, using the same payment instruments used in the transaction to be refunded.

For further information or to receive assistance regarding a refund request, the User is requested to contact Divinitinerari at the contact information provided.


8. Payment and Billing

In case of purchase of one of the services, the User can use the following payment methods: Credit/debit card: Divinitinerari will query the issuer of the User's card to request authorization to use it to pay for the service . Divinitinerari will not accept the User's request until the issuer has authorized the use of the card to pay for the requested service. When the issuer authorizes the use of the card, the necessary funds on the User's card will be "reserved" until the purchase process is completed or cancelled.

However, Divinitinerari will not charge your card until the purchase process is completed. For more information on the authorization and payment policy, Divinitinerari invites the User to contact the issuer of their credit/debit card Alternative payment methods: Divinitinerari will allow connection to the PayPal, Alipay, WeChat Pay and other accounts of the User to provide the e-mail address and password needed to confirm the payment.

9. Warranty and Liability

Divinitinerari points out that the Partner is:

the seller of the wine tourism experience;

the person responsible for providing the service to the User;

Therefore, Divinitinerari does not provide any guarantee and does not make any promise of quality and proper functioning of the Services.

10. Suspension and interruption of service

Divinitinerari reserves the right to add or remove functions or features or to suspend or completely interrupt the provision of the Service, both temporarily and definitively. In the event of definitive interruption, Divinitinerari will do everything possible to allow Users to download their information hosted at Divinitinerari.

In case of deactivation, refund requests are not accepted for payments already made even if these refer to portions of the Service not used by the User.

11. Resale of the Service

Users are not authorized to reproduce, duplicate, copy, sell, resell or exploit any portion of Divinitinerari and its Services without the express permission of Divinitinerari, granted directly or through a specific reselling program.

12. Indemnity

The User undertakes to indemnify Divinitinerari from any obligation or liability, including any legal fees incurred to defend themselves in court, which may arise in the event of damages caused to other Users or third parties, in relation to the contents uploaded online, the violation of terms of the law or the terms of these conditions of service.

13.Privacy Policy

For information on the processing of personal data, Users must refer to the Divinitinerari Privacy Policy.

14. Limitations of Liability

Except in cases of willful misconduct and gross negligence, Divinitinerari assumes no responsibility for direct and indirect damages suffered by the Customer and/or third parties deriving from the use and/or non-use of the Service. From now on, the Parties establish that the overall liability of Divinitinerari towards the Customer for any and all claims relating to or deriving from this Contract or based on requests for indemnity or contribution, may not overall exceed the amount paid by the Customer for the Service.

15. Changes to these Terms

Divinitinerari reserves the right to make changes to these Terms at any time, notifying the User by posting them on the Divinitinerari website.

The User who continues to use Divinitinerari after the publication of the changes accepts the new Terms without reservation.

16. Assignment of the contract

Divinitinerari reserves the right to transfer, assign, dispose of by novation or subcontract all or some of the rights or obligations deriving from these Terms, provided that the rights of the User provided for herein are not affected.

The User may not assign or transfer in any way their rights or obligations under these Terms without the written authorization of Divinitinerari.

18. Applicable law and jurisdiction

These Terms and all disputes regarding the execution, interpretation and validity of this contract are subject to the law, to the jurisdiction of the State and to the exclusive jurisdiction of the court of Cosenza, where the exclusive forum for the consumer is not applicable.

Pursuant to art. 14 of Regulation 524/2013 we also inform you that, in the event of a dispute, you can file a complaint via the European Union ODR platform which can be reached at the following link http://ec.europa.eu/consumers/odr/. The ODR platform is an access point for Registered Users who wish to resolve disputes arising from online sales or service contracts out of court

These General Conditions of Use of the Platform ("Conditions") establish the conditions under which the use of the website https://www.divinitinerari.it/it/ ("Platform") is permitted to the user both as a visitor and as a registered user (“User”). Use of the Platform means access, navigation or registration. By accessing the Platform or using it in any way, the User agrees to be bound by these Conditions.
